Albuquerque, NM(KKOB)- A Rio Rancho man is in custody in Doña Ana County after his arrest for several active arrest warrants and for allegedly sexually assaulting his girlfriend. 43-year old Brian Smolak, whose last address listed was in Rio Rancho, was arrested at a Las Cruces motel after the New Mexico State Police tactical team forced their way into the room he was staying in.
According to state police, his girlfriend was arrested for DWI in Socorro County after a traffic accident and when she was at the hospital to have blood drawn she reported she had been sexually assaulted allegedly by Smolak in Las Cruces.
NMSP took Smolak to the Doña Ana County Detention Center where he remains without bond. Reports said he had two extraditable warrants from Arizona, including one for aggravated assault on a peace officer. Authorities say he could face additional charges as the investigation is not finished.
