Santa Fe, NM (KKOB)- A lawsuit has been filed against the owners of a Tijeras daycare facility in connection with the death of their 1-year old son.
The lawsuit was filed in Santa Fe County, and it accuses the daycare, New Mexico Early Learning Academy, of malicious, willful, and reckless conduct in the death of Micah Tran who died after he was choking and according to the lawsuit, employees at the daycare failed to perform life-saving measures or call for medical services.
The suit also claims the facility fed Micah inappropriate food for his age. Micah had recently celebrated his first birthday before he died on Sept. 9.
In a statement from the daycare, it says in part, “Our hearts remain with the family, and we continually strive to uphold high standards for the safety and well-being of the children in our care. We continue to cooperate fully with the appropriate authorities and regulatory agencies as their review remains ongoing.”
Wording in the lawsuit indicates that the family may ask for compensation for Micah’s injuries, pain and suffering, the loss of his life, the loss of his “enjoyment of life” as well as punitive damages.
