Albuquerque, NM (KKOB) – A fight over how hot the green chile enchiladas were that two men were eating ended in one being shot and killed and the other behind bars.
APD homicide detectives charged 22-year old Ervin Gutierrez Saturday for the shooting Thursday night in Northeast Albuquerque.
According to police, the men were drinking alcohol while making dinner at an apartment with a relative and then got into a fight over the heat of the green chile enchiladas they were eating. After the fight, police say Gutierrez pulled out a handgun and shot the victim, Nathaniel Cavazos, 25, several times. Cavazos died at the scene.
Officers responded around 11:30 p.m. Thursday, to reports of the shooting at the Copper Hills apartments, located at 4200 Spanish Bit St., N.E. Gutierrez turned himself in to police on Saturday in Downtown Albuquerque.
Gutierrez is charged with an open count of murder and remains in the Metropolitan Detention Center.
