Albuquerque, NM (KKOB)- The 18-year old Albuquerque teenager arrested in a fatal traffic crash that killed an 11-year old boy will remain in jail until trial.
Malachi Velasquez-McCormick is facing charges of vehicular homicide, aggravated DWI, reckless driving, and having an open container.
During a hearing Thursday, the state arguing the community would not be safe from Velasquez-McCormick if he is let out of jail, especially since he was on probation at the time of the crash.
According to police and prosecutors, Malachi Velasquez-McCormick was drunk and high with passengers in his car and speeding on I-40 when he changed lanes to pass a semi. He then swerved back into his original lane, hitting an SUV carrying six people. 11-year-old Braxton Ahasteen was killed in the crash.
