Albuquerque, NM (KKOB)– A federal appeals court has sided with New Mexico in a legal fight over public water access. The Tenth Circuit rejected an appeal from private landowners and upheld a ruling supporting public use of rivers and streams. The case centered on access along the Pecos River and follows a 2022 New Mexico Supreme Court decision. Under the ruling, landowners cannot obstruct established public recreation routes. The Attorney General’s Office called the decision a win for constitutional protections.
