Albuquerque, NM (KKOB) – An Albuquerque man charged for a murder in 2017 during a shootout outside the Stardust Skies Park near Pennsylvania and Montgomery, will remain in jail after a jury was unable to reach a verdict in his first-degree murder trial.
29-year old Marco Martza is charged with killin Jon Paul Carbajal during an incident prosecutors are calling a robbery turned murder at the park. The jurors did find Martza not guilty on charges of armed robbery, and another charge.
The split verdict means that the Bernalillo County DA could retry Martza on the same charge, or second-degree murder and voluntary manslaughter.
