Albuquerque, NM (KKOB) –Española has agreed to pay $120,000 to settle a lawsuit accusing police of failing to protect a man from being run over by a former city councilor. The New Mexican reports that, Eric and Yvette Mondonca filed the complaint in 2024, saying Española police officers’ failure to arrest Phillip Chacon following a roadside altercation in 2022 left him free to attack Eric Mendonca with an SUV. The lawsuit also accused the police chief and police department of negligent training and hiring. Chacon is currently serving six years in prison in connection with the incident and a probation violation in another case.
