Albuquerque, NM (KKOB) — A wrongful death lawsuit filed Monday accuses New Mexico’s child welfare agency of failing to protect 5-year-old Xaquie Bynum. She died of carbon monoxide poisoning in a shack with no heat or running water in March 2024. The lawsuit claims CYFD ignored repeated warnings from family, teachers, and police over two years. Five investigations were launched, but attorneys say workers lied in reports and failed to check living conditions. Xaquie tested positive for meth.
